The Pre-Natal Diagnostic Techniques (Regulation and Prevention of Misuse) Act

The Pre-Natal Diagnostic Techniques (Regulation and Prevention of Misuse) Act, 1994 was enacted to provide for the regulation of the use of pre-natal diagnostic techniques for the purpose of detecting genetic or metabolic disorders or chromosomal abnormalities or certain congenital malformations or sex linked disorders and for the prevention of the misuse of such techniques for
the purpose of pre-natal sex determination leading to female feticide and for matters connected therewith or incidental thereto. For last few years there has been enormous increase in the no. of sonography Centre which have mushroomed in rural as well as Peri urban areas are blamed for conducting unscrupulous activity of sex determination at nominal cost. This has lead to significant rise is the Sex selection throughout. In most of Indian families the welcome of male child is done resulting in tremendous growth and popularity of centers doing sex determination followed by sex selective abortions. Such abuse of techniques is crime against female sex, diminishing the dignity and honor of woman. It was
thought appropriate to come out with a legislation which could regulate the use of, and to provide deterrent punishment for the violation of the provisions of the legislation. This Act was assented by the President on 20th September, 1994 and has been enforced with effect from 1st January, 1996 vide G.S.R. 706, dated 20th December, 1995. This act was been amended in 2003 as The Pre Conception and Prenatal Diagnostic Techniques (Prohibition of Sex Selection) Act.
